Official Rules

Promotional Partner / Spokesperson: [Tyler Deveraux / other promotional partner, if applicable]. Promotional partner is not the Sponsor and is not responsible for administration, winner selection, prize fulfillment, or compliance unless expressly stated in a separate written agreement.

These Official Rules are intended to describe the proposed structure for the The Summit Sweepstakes (the "Sweepstakes"). The Sweepstakes includes one guaranteed prize tier and additional conditional unlocked milestone bonus prize tiers. Only Tier 1 is guaranteed. Tiers 2 through 10 unlock only if the corresponding eligible-entry milestones are reached during the Sweepstakes Period.

1. Sponsor

The Sweepstakes is sponsored by Brookhaven Farms, LLC, d/b/a Brookhaven Performance ("Sponsor"), [COMPLETE MAILING ADDRESS]. Brookhaven Performance is a consumer brand operated by Brookhaven Farms, LLC.

Administrator: ViralSweep, [FULL LEGAL ENTITY NAME], [COMPLETE MAILING ADDRESS].

The Sweepstakes is publicly marketed as "The Summit Sweepstakes" and is presented in partnership with Peak Multifamily and Axxis Capital. Peak Multifamily and Tyler Deveraux serve as promotional partners and spokespersons; they are not the Sponsor or Administrator and are not responsible for administration, winner selection, prize fulfillment, or compliance except as expressly stated in a separate written agreement with Sponsor.

Sponsor is solely responsible for the conduct, administration, and fulfillment of the Sweepstakes, except for services expressly performed by Administrator. Any promotional partner, spokesperson, affiliated media personality, platform, app store, social media platform, payment processor, email provider, or technology vendor is not the sponsor or administrator of the Sweepstakes.

2. Eligibility

The Sweepstakes is open only to legal residents of the United States and the District of Columbia, excluding Florida and New York, who are eighteen (18) years of age or older at the time of entry.

The Sweepstakes is void in Florida, New York, Puerto Rico, all U.S. territories and possessions, and wherever prohibited or restricted by law.

Residents of Florida and New York are not eligible to enter or win, whether through a Brookhaven Performance subscription, Brookhaven Performance app activity, mail-in entry, or any other method of entry. Entries submitted by residents of Florida, New York, or any other excluded jurisdiction are void.

Employees, officers, directors, agents, contractors, and representatives of Sponsor, Administrator, any promotional partner, their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, prize suppliers, technology providers, and any other entities involved in the development, production, implementation, administration, fulfillment, or promotion of the Sweepstakes are not eligible to participate. Immediate family members and household members of such individuals are also not eligible. "Immediate family" means spouse, parent, child, sibling, and each of their respective spouses, regardless of where they reside. "Household member" means any person who shares the same residence, whether legally related or not.

Participation constitutes entrant\'s full and unconditional agreement to these Official Rules and Sponsor\'s decisions, which are final and binding in all matters relating to the Sweepstakes.

3. Sweepstakes Period

The Sweepstakes begins on June 1, 2026 at 12:00:00 AM Eastern Time ("ET") and ends on December 31, 2026 at 11:59:59 PM ET (the "Sweepstakes Period").

Sponsor\'s computer and/or Administrator\'s platform clock shall be the official timekeeping device for the Sweepstakes.

4. How to Enter

There are three methods of entry:

1. Subscription entries;
2. Engagement bonus entries; and
3. Alternative Method of Entry ("AMOE") entries by mail.

Methods 1 and 2 require an active paid Brookhaven Performance subscription. Method 3 does not require any purchase, payment, subscription, app download, or account creation.

All entries, regardless of method, are subject to the entry limits stated in these Official Rules.

4.1 Subscription Entries

Eligible entrants who are active paid subscribers to Brookhaven Performance may receive entries each month their subscription is active and current, according to the following schedule:

Subscription entries accrue on the first day of each successful billing cycle during the Sweepstakes Period.

Subscriptions that are paused, lapsed, cancelled, refunded, charged back, declined, reversed, or otherwise not in active paid status will not accrue entries during the affected period. A subscription that is resumed after lapse may resume accruing entries on the next successful paid billing cycle, but entries will not be awarded retroactively for any lapse period.

Free trial subscriptions do not generate entries. Entries begin accruing only after the first successful paid billing following conversion from a free trial period.

Sponsor reserves the right to void entries associated with fraudulent transactions, cancelled orders, chargebacks, payment disputes, abuse, manipulation, or any violation of these Official Rules.

4.2 Engagement Bonus Entries

Eligible entrants with active paid Brookhaven Performance subscriptions may also receive engagement bonus entries through qualifying actions recorded in the Brookhaven Performance app or related Brookhaven systems.

Qualifying engagement actions may include, without limitation:

• Completed workouts;
• Achieved personal records;
• Qualifying nutrition days;
• Qualifying supplement adherence days;
• Streak milestones;
• Rank advancements;
• Other Brookhaven Performance app events disclosed in the app or campaign materials.

Specific entry values for engagement events may be displayed within the Brookhaven Performance app, campaign dashboard, or other official campaign materials.

Engagement bonus entries are capped at a maximum of one (1) times the entrant\'s subscription entries for the applicable calendar month.

Example: If an entrant receives thirty (30) subscription entries in a month, that entrant may receive no more than thirty (30) engagement bonus entries for that same month, for a maximum monthly total of sixty (60) entries.

Engagement actions in excess of the monthly cap do not create additional entries, are not banked, are not carried forward, and are not applied to any later month.

Sponsor\'s records determine whether an engagement action qualifies for entries.

4.3 Alternative Method of Entry, No Purchase Necessary

To enter without purchase, payment, subscription, app activity, or app download, hand print the following information on a 3" x 5" card:

• Full legal name;
• Complete mailing address;
• Email address;
• Date of birth;
• Daytime telephone number; and
• The phrase: "BROOKHAVEN PERFORMANCE FOUNDERS SWEEPSTAKES ENTRY."

Mail the completed 3" x 5" card in a separate, hand-addressed #10 envelope with sufficient postage to:

Each AMOE submission must be hand printed, mailed separately, and limited to one entry request per envelope. Mechanically reproduced, photocopied, automated, bulk, or third-party-generated submissions are void.

AMOE entries are subject to the same overall entry limits as paid/subscription/app-generated entries. AMOE entries have the same odds of winning as all other eligible entries.

AMOE entries must be postmarked by December 24, 2026 and received by December 31, 2026 to be eligible for the January 1, 2027 final drawing. To be eligible for earlier drawings, AMOE entries must be postmarked by the day before the applicable drawing date and received before that drawing is conducted.

Sponsor and Administrator are not responsible for late, lost, stolen, delayed, damaged, illegible, incomplete, misdirected, postage-due, or undeliverable mail. Proof of mailing does not constitute proof of receipt.

4.4 Entry Limits and AMOE Parity

Regardless of method of entry, each eligible person may receive no more than [PLACEHOLDER: MAXIMUM ENTRY LIMIT, Sponsor recommendation: 2, 000 entries per entrant, providing universal cap that matches the highest realistic paid path (Combo + 3 add-on bottles × 7 months × 2× engagement cap = ~1, 960 entries) and remains achievable via AMOE at approximately 67 mail-in submissions] total entries during the Sweepstakes Period.

Multiple entry methods may not be used to exceed the stated entry limit.

The maximum AMOE entry opportunity must be equal to the maximum number of entries available through the paid/subscription/app-entry path. Sponsor will set the final maximum entry limit before launch after confirming the maximum possible subscription and engagement entry path.

For legal/compliance review, Sponsor and Administrator should confirm whether the final structure uses:

• Option A: One universal entry cap that applies to all entrants; or
• Option B: An AMOE structure that allows no-purchase entrants to obtain the same maximum number of entries as the highest possible paid/app entrant.

Until legal approval, this section should not be published without a final entry limit.

5. Prizes and Unlocked Milestone Bonus Prize Structure

The Sweepstakes includes:

1. One guaranteed prize tier; and
2. Conditional unlocked milestone bonus prize tiers.

Tier 1 is guaranteed and will be awarded regardless of total eligible entry count.

Tiers 2 through 10 are conditional milestone bonus prize tiers. A milestone bonus prize tier unlocks and is added to the Sweepstakes prize pool only if the corresponding eligible-entry milestone is reached by the deadline stated in these Official Rules.

If a milestone bonus prize tier does not unlock, that tier will not be drawn, will not be awarded, and no substitute prize, cash equivalent, or alternate prize will be provided.

Sponsor\'s official records of eligible entries and milestone progress shall control in all matters relating to whether a milestone bonus prize tier has unlocked.

5.1 Key Milestone Disclosure

Only Tier 1 is guaranteed.

Tiers 2 through 10 are not guaranteed. Tiers 2 through 10 unlock only if their corresponding eligible-entry milestones are reached by 11:59:59 PM ET on December 31, 2026, as determined by Sponsor\'s official records.

Milestone bonus prize tiers whose milestones are not reached will not be added to the prize pool, will not be drawn, and will not be awarded.

No substitute prize will be provided for any milestone bonus prize tier that does not unlock.

Milestone progress may be displayed publicly at https://www.brookhavensupplements.com/pages/peak-prizes.

Maximum total ARV of all prizes if all milestones are reached and all prizes are awarded: $324, 000 (approximate).

The guaranteed prize pool ARV is $10, 000.

All ARV values are estimates and must be finalized before launch. ARV values for any prize involving services, access, appearances, coaching, travel, or experiences must reflect reasonable fair market value as of the Sweepstakes start date.

5.3 Prize Details

Detailed prize descriptions, components, limitations, travel terms, scheduling restrictions, substitutions, exclusions, and fulfillment conditions may be set forth in a separate Prize Specification Schedule, which is incorporated into these Official Rules by reference if posted or attached.

In the event of a conflict between these Official Rules and any prize description, these Official Rules control unless otherwise required by law.

All prizes are awarded "as is" without warranty or guarantee, express or implied. Prizes are non-transferable, non-assignable, and not redeemable for cash except where required by law or at Sponsor\'s sole discretion.

Sponsor reserves the right to substitute a prize or prize component with another prize or component of equal or greater value if the advertised prize becomes unavailable, impracticable, unlawful, or impossible to fulfill.

5.4 Prize Conditions

Winners are responsible for all federal, state, and local taxes and all costs and expenses associated with prize acceptance, receipt, ownership, use, and enjoyment that are not expressly stated as included.

Travel-related prizes, if unlocked and awarded, are subject to availability, scheduling restrictions, blackout dates, travel-provider terms, valid identification requirements, passport/visa requirements where applicable, and other restrictions. Winners and guests, if any, are responsible for all personal expenses, meals, incidentals, gratuities, ground transportation, upgrades, baggage fees, travel documents, insurance, and other costs not expressly included.

Experience-based prizes involving a promotional partner, spokesperson, coach, expert, or other individual are subject to scheduling and availability. Sponsor will use commercially reasonable efforts to schedule any such experience. If the applicable individual becomes unavailable due to illness, emergency, force majeure, scheduling conflict, termination of relationship, or other reason outside Sponsor\'s reasonable control, Sponsor may substitute an experience or prize of equal or greater value.

For any prize with an ARV of $600 or more, winner may be required to complete IRS Form W-9 and will receive an IRS Form 1099-MISC or other required tax form reflecting the ARV of the prize and any cash payment received.

5.5 Tax Gross-Up, If Any

Sponsor may provide a tax-assistance cash payment for certain high-value prize tiers, if stated in the final prize schedule.

Tax-assistance payments, if any, are themselves taxable income and will be reported to the winner as required by law. Sponsor does not provide tax advice. Winners should consult their own tax advisors.

Unless expressly stated in the final prize description, no tax gross-up or tax-assistance payment is included.

6. Drawing Schedule

Drawings will be conducted according to the schedule below, subject to the milestone unlock rules stated in Section 5.

All drawings for the guaranteed Tier 1 prize and for any milestone bonus prize tier that unlocks during the Sweepstakes Period will be conducted on or before January 1, 2027.

Once a milestone bonus prize tier unlocks, Sponsor will conduct that Tier\'s drawing at Sponsor\'s discretion at any time on or before January 1, 2027, in accordance with applicable law. Sponsor may stage drawings progressively as milestones are reached or consolidate drawings closer to the end of the Sweepstakes Period.

Final drawings will be conducted by Sponsor, Administrator, or their designee using a random selection method intended to provide each eligible entry an equal chance of selection within the applicable drawing pool. Sponsor reserves the right to adjust drawing timing if necessary for compliance, mail-in entry processing, technical integrity, force majeure, or other administrative reasons, provided that any such adjustment is made in accordance with applicable law and does not materially impair entrant rights.

6.1 Eligibility for Drawings

Each drawing will be conducted from among all eligible entries received during the applicable eligibility window, subject to the milestone unlock conditions.

An entry is eligible for any drawing whose eligibility window includes the entry\'s accrual date or AMOE postmark date, provided the entry is otherwise valid and received before the applicable drawing is conducted.

Early entries may be eligible for multiple drawings if the applicable eligibility windows include those entries.

A single entrant may be selected as a winner in multiple drawings across different tiers, but no entrant may win more than once within the same tier drawing unless expressly stated otherwise.

6.2 Drawing Methodology

Winners will be selected by random drawing from among all eligible entries for the applicable drawing. Drawings will be conducted by Sponsor, Administrator, or their designee using a random selection method intended to provide each eligible entry an equal chance of selection within the applicable drawing pool.

Sponsor may publish a redacted winner-selection verification process, public random seed, entry-count summary, audit log, or other verification information at https://www.brookhavensupplements.com/pages/peak-prizes.

Sponsor reserves the right to use a simplified random drawing method approved by Administrator and/or legal counsel if the originally proposed verification method is impracticable, unavailable, or creates unnecessary operational complexity.

7. Winner Notification and Verification

Potential winners will be notified by email, telephone, or other contact method using the information associated with the entrant\'s Brookhaven Performance account or AMOE submission.

Potential winners must respond and complete all required verification documents within fourteen (14) days of initial notification, unless a shorter or longer period is stated in the notification.

Failure to respond, failure to complete verification, failure to provide required documents, ineligibility, noncompliance with these Official Rules, or return of a prize or notification as undeliverable may result in disqualification and selection of an alternate potential winner.

Sponsor may require potential winners to provide:

• Affidavit or declaration of eligibility;
• Liability release;
• Publicity release where permitted by law;
• IRS Form W-9;
• Government-issued photo identification;
• Proof of residence outside Florida and New York;
• Proof of age;
• Background check authorization where permitted and relevant to the prize;
• Travel companion releases where applicable;
• Any other documents reasonably required to verify eligibility and award the prize.

Acceptance of a prize constitutes permission for Sponsor and its designees to use winner\'s name, likeness, voice, city/state of residence, prize information, statements, and biographical information for advertising, promotional, public relations, and other commercial purposes in any media worldwide without additional compensation, notice, or approval, except where prohibited by law.

8. State Eligibility; No Florida or New York Registration

The Sweepstakes is void in Florida and New York. Residents of Florida and New York are not eligible to enter or win.

Sponsor will use commercially reasonable measures to prevent entries from Florida and New York residents, including account-address review, billing-address review, shipping-address review, IP/geolocation screening where practical, AMOE address review, and winner eligibility verification.

Because residents of Florida and New York are excluded from eligibility, Sponsor does not intend to register or bond the Sweepstakes in Florida or New York.

Any entrant determined to be a resident of Florida, New York, or any other excluded jurisdiction will be disqualified and all entries submitted by that entrant will be void.

Sponsor reserves the right to modify, suspend, terminate, or update the Sweepstakes if required to comply with applicable law, regulator guidance, Administrator requirements, or legal counsel recommendations.

9. Public Progress Page and Campaign Integrity

Sponsor may maintain a public progress page at https://www.brookhavensupplements.com/pages/peak-prizes.

The progress page may display:

• Current cumulative eligible-entry count;
• Current progress toward each milestone bonus prize tier;
• Unlocked or locked status of each milestone bonus prize tier;
• Drawing dates;
• Winner announcements, subject to verification and consent;
• Official Rules and updates;
• Other campaign integrity information.

Any public counter or progress display is provided for entrant transparency and may be subject to reasonable processing delays, audits, fraud review, AMOE processing, returns, chargebacks, eligibility screening, or technical adjustments.

Sponsor\'s official internal records, as reviewed by Sponsor and/or Administrator, control in the event of any discrepancy between the public progress page and Sponsor\'s official records.

10. Fraud, Abuse, and Disqualification

Sponsor reserves the right to disqualify any person and void any entries if Sponsor determines, in its sole discretion, that such person has:

• Violated these Official Rules;
• Submitted false, incomplete, misleading, or fraudulent information;
• Used multiple identities, accounts, addresses, or devices to circumvent entry limits;
• Manipulated or attempted to manipulate subscription, billing, app engagement, referral, or AMOE systems;
• Engaged in automated, scripted, bot, bulk, or third-party entry activity;
• Tampered with the operation of the Sweepstakes;
• Acted in an unsportsmanlike, disruptive, abusive, threatening, or unlawful manner;
• Resided in or entered from an excluded jurisdiction; or
• Otherwise attempted to undermine the integrity of the Sweepstakes.

Sponsor\'s decisions regarding fraud, abuse, and disqualification are final and binding.

11. Privacy

Information collected from entrants will be used in accordance with Sponsor\'s Privacy Policy, available at https://www.brookhavensupplements.com/policies/privacy-policy, and these Official Rules.

By entering, entrants consent to the collection, use, processing, transfer, storage, and disclosure of their personal information for purposes of administering the Sweepstakes, verifying eligibility, awarding prizes, complying with legal obligations, fraud prevention, and, where consent is provided or permitted by law, marketing.

Entrants may be required to provide personal information to Sponsor, Administrator, prize suppliers, tax processors, legal/compliance providers, or other service providers involved in Sweepstakes administration.

12. Limitation of Liability

By participating, entrants agree to release, discharge, indemnify, and hold harmless Sponsor, Administrator, promotional partners, prize suppliers, advertising and promotion agencies, social media platforms, app stores, technology providers, payment processors, email providers, and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, representatives, agents, successors, and assigns from and against any claim, liability, loss, damage, injury, cost, or expense arising out of or relating to participation in the Sweepstakes or acceptance, receipt, possession, use, misuse, or inability to use any prize.

Released parties are not responsible for:

• Lost, late, delayed, incomplete, invalid, unintelligible, misdirected, damaged, or undeliverable entries;
• Technical failures, app failures, website failures, API failures, internet outages, server failures, email delivery issues, payment-processing errors, or data errors;
• Unauthorized human intervention;
• Incorrect or inaccurate entry information;
• Printing, typographical, administrative, or other errors;
• Fraud, tampering, hacking, or attempted manipulation;
• Mail delays or lost AMOE submissions;
• Any injury or damage caused by participation or prize use.

If, for any reason, the Sweepstakes cannot be conducted as planned, Sponsor reserves the right to cancel, modify, suspend, or terminate the Sweepstakes and, if appropriate, award the guaranteed prize and any unlocked milestone bonus prizes from among eligible entries received before the action taken.

13. Disputes

Except where prohibited by law, entrants agree that any disputes, claims, or causes of action arising out of or connected with the Sweepstakes or any prize shall be resolved individually, without resort to any form of class action.

All disputes shall be governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.

Entrants consent to the exclusive jurisdiction and venue of the state and federal courts located in Washington County, Tennessee, except where prohibited by law.

Entrants waive all rights to claim punitive, incidental, consequential, special, or indirect damages, and waive the right to have damages multiplied or increased. Entrants\' recovery shall be limited to actual out-of-pocket costs of participating in the Sweepstakes, excluding attorneys\' fees, except where prohibited by law.

14. Platform Disclaimers

This Sweepstakes is not sponsored, endorsed, administered by, or associated with Apple Inc., Google LLC, Meta Platforms, Inc., Instagram, Facebook, TikTok, X, YouTube, Shopify, Klaviyo, Stripe, or any other social media, app store, payment, ecommerce, or technology platform unless expressly stated.

Entrants release all such platforms from any liability relating to the Sweepstakes.

15. Winners List and Rules Requests

For a copy of the winners list, available after January 31, 2027, or a copy of these Official Rules, send a self-addressed, stamped envelope to:

16. Acknowledgment of Conditional Milestone Bonus Prize Structure

By entering the Sweepstakes, each entrant acknowledges and agrees that:

1. Tier 1 is the only guaranteed prize tier;
2. Tiers 2 through 10 are conditional milestone bonus prize tiers;
3. A conditional milestone bonus prize tier unlocks only if the corresponding eligible-entry milestone is reached during the Sweepstakes Period;
4. If a milestone is not reached, the corresponding milestone bonus prize tier will not unlock, will not be drawn, will not be awarded, and no substitute prize will be provided;
5. Sponsor\'s official records determine eligible-entry totals and milestone status;
6. Public progress displays are for transparency and may be subject to processing delays, fraud review, AMOE processing, and audit adjustments; and
7. Entrant\'s participation constitutes acceptance of this conditional structure.

17. Modification, Suspension, or Termination

Sponsor reserves the right to modify, suspend, or terminate the Sweepstakes, in whole or in part, if Sponsor determines that fraud, technical failures, legal requirements, regulatory concerns, force majeure, unauthorized human intervention, or any other cause impairs or may impair the integrity, security, fairness, legality, or proper conduct of the Sweepstakes.

If the Sweepstakes is cancelled or terminated early, Sponsor will award Tier 1 and any milestone bonus prize tiers that have already unlocked, if legally and practically possible, from among eligible entries received before cancellation or termination.

Any modifications will be posted at https://www.brookhavensupplements.com/pages/peak-rules or https://www.brookhavensupplements.com/pages/peak-prizes, subject to applicable law.

18. Severability

If any provision of these Official Rules is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or severed if modification is not possible. The remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Official Rules, together with any incorporated prize schedule, privacy policy, and official campaign materials expressly referenced herein, constitute the entire agreement between Sponsor and each entrant regarding the Sweepstakes and supersede all prior or contemporaneous communications, representations, or agreements relating to the Sweepstakes.
